Do You Think the Supreme Court Is a Good Example of Originalism?
i don't find a single case that is not guilty of finding those prior positive law fundamental rights and misusing them. Ro versus wade, none of these cases that came out of the warren court, in the burgher court defend their conclusions on originalist grounds. That was the high water mark of living constitutionalism. And you might call making it up.
