Federal laws prohibiting troops from organizing and joining unions don't apply to guard troops when they're in a state act of duty status. As a result, these troops are able to organize into the texas state employees union. The idea actually came out of the pandemic response. They teamed up with the veterans law clinic at yale and a couple of state employees unions,. A lawsuit seeking an opinion from a federal judge on whether they could unionize while on state active duty.
And in Texas, they’re trying to unionize.
