What Happens When You Receive Ineffective Assistance of Counsel in a Criminal Trial?
The Supreme Court essentially said this term is not much. The federal courts can't intervene, and one consequence of that is a man who was convicted of a murder he almost certainly did not commit will now likely be executed. What worries me about this development is I think it's exposing that originalism,. you know, the idea that you can look to these historical sources to derive the law is less a constraining force. And more just a rhetorical technique.
