The Skeleton Argument in the Court of Appeal
The Supreme Court is more likely to be interested in the jurisprudence of other countries. It tends to go back to first principles when deciding how to determine an appeal, much more so than the Court of Appeal. And that reflects a difference between the approach of the two courts. The Supreme Court is much more interested in principle.
