The Justice Department Bans the Use of Subpoenas to Seize Communications Records
The Justice Department this week formally banned the use of subpoenas and court orders to seize communications records like notes and tapes of reporters in order to try to get them to testify. This is a move toward, as Merrick Garland said, recognizing the crucial role that a free and independent press plays in our democracy. And it's always just really interesting whether reporters get treated with a kind of extra solicitude as opposed to anybody else who a source might be talking to.
