The court of appeals ruled that they can. And there are copyright holders who created a p is who are still relying on that ruling to say we have about copyright. The capy, right ability question is still important and hanging out there. We do know it's fair use if you're working in an entirely differet environment and doing something different. When you are just trying to compete, it's an open question whether it'll be fair use.
