In a grand jury, the Panthers wouldn't know what he said or if he said anything. Even if all he did in the grand jury room was assert his privilege not to answer a substance of questions, I think the Panthers justifiably would have cut off access to him. This became a big part of Anthony Amsterdam's defense for Earl. They rooted this idea of reporter's privilege in the First Amendment. The court was sympathetic to the argument, but still ruled that Earl should go before a grand jury to authenticate his reporting.
