Is All Camera Surveillance Now a Search?
One would be that all camera surveillance is now a search. Another possibility is, and this is kind like the mosaic theory of the fourth amendment: maybe it's not a search if the government uses cameras in some ways but not others. I don't personally think which language,. which term is used is a lot less important than how whatever the term you use ultimately is employed in terms of what doctrinal rule get a ruling. And so i'd li'd love to see more exploration of what the who knows options are before it gets to the supreme court.
