The US and the EU Are More Cautious in Their Response to Sanctions
I think this is likely that in a crisis response and things move at rapid pace and sometimes you don't take certain actions that were obvious in hindsight. The efforts to freeze or hold the Russian central bank assets wasn't planned beforehand. This is what the US and the EU decided to do to upscale basically the level of response vis-a-vis other events like actually the invasion of Crimea. I can't really judge the legal argument so well but morally I think the case is unanswerable. Of course we should take this money and use it for Ukraine.
