If you are acquitted of a crime, it becomes very hard for the prosecution to retry you. The judge allowed for provocation to be argued by prosecutors. Jurors are given specific instructions as to how to evaluate the facts. If the jury concludes that written house provoked the attack, then you lose the privilege of arguing self defence.
