Rhee: Strickland v. Washington is a 1984 Supreme Court case about ineffective assistance of counsel. She says the court created a test to figure out whether a criminal defendant's lawyer is adequate. Rhee: The problem is that the test they created ended up being so pliable it failed to guarantee criminal defendant's competent representation at all.
