The Fifth Circuit's Decision to Allow Status Quo to Stay in Place
The Fifth Circuit is arguably even more conservative than the last one. So looking at that alone we would expect those judges to have a lot of sympathy for the plaintiff's claims. The question if you're this Fifth Circuit panel and you think the plaintiffs are right for whatever reason is do you push the envelope and give the plaintiffs a big win in hope to persuade some of those conservative justices on the US Supreme Court to change their mind or do you kind of acknowledge the writing on the wall?
