The fourth circuit looked at those arguments and rejected them. They upheld the challenged admissions policy at Thomas Jefferson. This was a two to one opinion with two Democratic appointees, Judge King and Judge Hitans in the majority. And this is very likely headed to the Supreme Court. After the Supreme Court likely six justices are going to most likely scrap race, conscious admissions policies.
