The second circuit's decision sided with the photographer, and it said, the fair use doctrine requires a fundamentally different and new artistic purpose and character. The fighting point really has been whether or not an artist intent or concept in the secondary use is sufficient in it of itself to be a transformative use. And we should just say that what we're looking or in these closhed cases, is some sort of transformative use.
