In 2003, Sandra Day O'Connor wrote the majority opinion in Grutter versus Bollinger. This is a key target to overturn if we want to get rid of the diversity industry as it exists today. The critical mass argument was explicitly vindicated and rafied also the idea that underrepresented minorities represent diversity. That shifts the frame into standpoint theory or that positionality analysis from intersectionality.
