Bad Man Stays in Jail?

There used to be a little colloquial rule on the with some judges will just say some circuit judges. Bad man stays in jail is the name of the rule. But if and means or it's pretty bad for the criminal defendant because any one of these means he doesn't get the safety valve. If you have to meet all three, then why is a included at all?
