The Function of the Judiciary
The judiciary doesn't put in place rights at all, the judiciary is adjudicating whether or not they are constitutional. And i would just underline the separation of pow s bit right? Because of having the executive separate from the legislative, i think that it's going to go to the impossibility of having non capricious execution and generation of laws. That's the essential problem of despotism.
