The First Amendment Is Violated by Informal Government Pressure on Social Media Platforms
Bantam books, which has this somewhat Lucy Gucci, but much broader notion of when this kind of job earning or informal pressure could satisfy state action and violate the First Amendment. Courts have relied on this bloom the year, resky test or language to develop a very, very narrow test in social media cases. And it basically ignores all of the prior precedent that says blooms are really, really, really narrow tests. It just says, you know, what does significant encouragement mean? Well, it means that the government's encouraging.
