The Biden Policy and the Refugee Act of 1980
Sarah Binder: This is very similar to the Trump policy. The same judge and same group, frankly, went to this same judge. He tossed out that policy that was upheld on appeal. She says Congress has got to do its job here regarding immigration policy.Binder: If it is no longer manageable, for example, to have a statement that says any alien physically present, regardless of their status or irrespective of such alien status may apply for asylum then if that's not tenable, that law needs to change.
