Is There a Right to Abortion?
In 19 73, the court simply tax on that vision of privacy to this question of whether there is a right to terminate a pregnancy. The reason why we have not seen a wider range of argument supporting the abortion right is because the court decided it on substantive due process grounds. In later cases like casey, you see the seeds of an equality argument emerge.
