The court is debating when parties are liable for the conduct of other parties, third-party liability. I was struck by how many justices in the Tom Nkase wanted to have specific knowledge of particular bad actors and this connection between the video and specific bad acts. The inability for counsel's fault, but it's also just because these cases are a little out over their skis in terms of their complicatedness and the facts of them that they weren't great cases for the court to take.
