There is sort of a someone apples and oranges. I think he's wrong about the absolute immunity regardless of whether he has the legislative privilege. It would establish a terrible precedent for Congress to summon a vice president of the United States to speak about deliberations that took place at the White House. The court is going to have a serious problem with that but I'm not sure I think he could plausibly say well what I meant to say was the House can't make me testify but I didn't say that about the Senate.
