If there was no defamation law and you didn't have the right to sue some one for defaming you, then people would be more sceptical of claims. I think that if you had a hotel chain that held itself out as being howard johnson's or whatever, when that's not authorized by the original corporation, then a customer basically is being deceived. So it would be in your interest to actually get a license from howardjohnson so that you're not defrauding the customer. Yet, i usually focus upon patentan copyright because they're very similar and they both do the most damage. Trade mark is a little bit subtly different, and people don't quite understand it
