Is It Possible That the System Caused the Mistake?

It may be that this case was brought because they knew they could easily meet all the elements, and they were looking for a case in order to shake up this complacent environment. I don't know that for a fact, but that is something that you take into account when medical boards and also the law enforcement community often bring cases to a prosecutor's office. And it's possible that that factored into why they brought this case, whether they should have done it, and whether it will have that effect. But i think instead it was overreached.
