There have definitely been periods where the court has been more true to that mandate than other times. I think one thing we try to do is use history to point out where the courts or where the justices have tried to do that in the past, and look at the results. Scott: The most notorious example of a Chief Justice sort of political antenna up trying to figure out how to navigate the politics would be Taney's decision on slavery.
