Can a Conflict of Interest Analysis Ever Have Criminal Implications?

The conflict of interest analysis is really an issue for bar associations. It's a matter for lawyer discp in the first part. But can situations like this ever have criminal implications? Well, they can if, a, the lawyer is being used as a conduit to try to intimidate a witness into lying or failing to reveal certain facts that could be aging to the person who's paying the fees. So yes, it could cross that line. I don't think we've seen anything to indicate it has yet.
