In 1999, when Marvel went into bankruptcy, any contract can be avoided if it helps save the company. So basically his right to make Marvel toys could completely disappear which was a very big important part of his business. He would lose a lot of money. The bulk of Marvel's income in the 1990s came from comic books and they had not made any films at that point. In the 90s there were no Marvel films.
