The Framers' Take on the Judiciary
The framers didn't want judges involved in either the legislatove process, or reviewing laws they would eventually have to adjudicate. They did not intend to grant general authority to the judiciary to rule on the constitutionality of legislative acts. The convention crafted a judiciary like many other provisions in the final constitution as a product of compromise. It was a compromise between the interests of the individual states and the need for a federal government that would be strong enough,. flexible enough to meet the present and future needs of the nation.
