The Supreme Court has told lower courts that they can do the sequencing of answering the relevant questions in whichever order they want. In fact, the actual rule is you do have to find a case with functionally identical facts that was already decided before you can bring your case. "It's a huge problem because it essentially provides a green light and a free pass for police to continue engaging in conduct that everybody understands is unconstitutional," he says.
