What Is a Fourth Amendment Search?
The question of how the fourth amendment should apply to pole cameras, which is our problem here, is really, really hard. On one hand, you've got a background rule that public visual surveillance is not a search. Andt think that's cats, that that's precat's law. That goes back to antic versus carrington, talking about the eye cannot commit a trespass in 17 65.
