The judge could have said in a summary judgment ruling that actual malice has been established. The jury is going to have to decide whether this meets the actual malice standard, which is the First Amendment standard. Fox knew these statements were wrong. They ran them anyways. All of the incentives were lined up for Fox to lie. We're not even going to debate that or litigate it at the trial. Just figure out what the damages is.
