The Supreme Court Is Sending Messages to the Lower Courts on Qualified Immunity
"The Supreme Court did this GVR thing where it said look we don't even need briefing that's not right and set it back down," he says. "I think what's pretty clearly going on is that the Supreme Court has no interest whatsoever in revisiting qualified immunity." He urges lower courts to find a sweet spot for throwing out most civil rights cases, but not those that make us look ridiculous.
