The Future of SEC Regulation
The SEC delegates a substantial amount of its oversight authority to FINRA, which is a private body. The courts interpret the law and create new law through case law. Congress needs to do something here, no matter what. But it won't have the detail and local on-the-ground knowledge to create tailor made regulation for novel use cases.
