The Common Law and Equity
Common law is not very common, and the common law has not much common sense. Our students often get confused as to what the lecturers mean when they use the word 'common law' In the narrowest sense, the common law is sometimes contrasted with equity. When we think about where rules come from or the origin of a rule will often try and distinguish them by distinguishing between that common law or equity.
