Is the Supreme Court a Guardian of the Constitutional Rights of Minorities and Other Communities?
The idea of giving rights to an individual to be trumped in the face of tyrannical majorities is a counter-majority and idea. I would say by and large the problem with the court it's not that they don't come to the defense of say free speech. The question whether they always fulfill that that is a for debate I think. They have been notable instances when they have not done so.
