The question is whether or not it was unreasonable, objectively unreasonable, under existing case law. Fewer than 4% of the cases get dismissed once that evidence is presented before trial. If a police officer comes forward and says, well, I thought what I did was excessive, that's the subjective standard. That is not likely to get very far.
