How Does SB 7072 Interact With State Laws?
SB 7072 says that a social media platform may not apply or use post prioritization or shadow banning algorithms for content and material posted by or about a political candidate. HP 20 says that you cannot quote, censor based on viewpoint,. It includes within that definition, de boosting denying equal access or visibility, or otherwise discriminating against expression. Those state laws right there require the platforms to do exactly what the petitioners in Gonzalez versus Google would like to make the platforms liable for doing.
