A judge declared a Buenos Aires fugitive facial recognition system unconstitutional. The Ninth Circuit maintained that section 230 liability, although the judges on that panel were divided on the issue. I think the Supreme Court saw this as an opportunity to clarify the full extent of section 230 and its protections.
