The Costs of Having a Broader First Amendment Role
The courts are just really worried about the costs of having to broader first amendment role. And I think also there is this worry about government speech interests too. You know, you can't have a democratic government if you don't have a government that is able to take policy positions. We want to protect the ability of government actors to speak.
