Originally, it seems very clear that the Electoral College was in some form a kind of a deliberative body. But by the time we got to the 12th Amendment, people decided they wanted to do a different thing. Justice Kagan did not persuade me and I don't think anybody else but she went basically to the prescriptive constitution saying it's not the role of the Supreme Court to upset all these kinds of arrangements.
