The Reasonable Basis Test Is Not Legitimate

The rational basis test doesn't seem to have any foundation at all in the Constitution, he says. The only one I can think of that on its face might go in that direction would be the art of the Fourth Amendment which says no unreasonable searches and seizures. Neither its text nor it's original understanding includes any kind of this general rule rule of fairness.
