The Role of the FDA in the Safety of a Drug

The Supreme Court made a huge wrong turn in a case called luhan. The question is, was that regulation designed for the benefit of this category of litigate? Was it instead designed for the passengers to keep them safe from sheep just bumping into them on the deck or something? So, that's a standing like question. For whose benefit is the regulatory rule adopted? And if the legislature is absolutely explicit, oh, that's easy. But oftentimes, the legislature is not explicit. It talks about maybe who's regulated but not for whose benefit. Ultimately, that's not in my view an article three question.
