The Court Is Not the Place Where This Decision Should Be Made
Justice Scalia said, basically if you want this to happen that's fine but you're going about it the wrong way. He sees this as a small minority imposing their views on everybody else. The court is not the place where this decision should be made. Persuading one's fellow citizens is one thing and imposing one's views in absence of democratic majority will is something else.
