The Myth of Emergency Relief
A stay pending appeal is basically the appellate court saying slow down trial court, like we need some time to figure out whether we're going to let your rule and go into effect. And that's what, you know, we the nerd lawyers call an emergency application, then the emergency application can get appealed to the Supreme Court. That rough fact pattern is what has become so de rigour, has what has become such a common staple of the Supreme Court's emergency docket of procedural orders of the whole melange.
