The Hermes Ruling in the Hermes Case Was Seen as Negative for NFTs

The Hermes ruling was actually seen as negative for NFTs now some of this I was reading a New York Times article and not that we should they have no idea what's going on. Like the artist was trying to claim that he was artistically rendering a Birkin bag and that he's therefore protected on the First Amendment in the way that a war hall was when he did a Campbell soup drawing or something like that. The judge ruled in in Hermes's favor which again I understand then in a twisted way the New York Times took that as like see they're ruling this it wasn't art but I actually think it's interesting because NFTs are more than just art right?
