The Importance of Transparency Mandates on Financial Institutions
I like the transparency mandate. I've sort of proposed that financial services heavily regulated require transparency of all sorts, and that provides an interesting model for social media as well. But one argument that you have to grapple with is whether transparency mandates imposed on expressive actors pose special kinds of risks. And it's hard to see how there are very few transparency mandates that would survive First Amendment scrutiny.
