What Is Substantial De Pro?
I still feel like a dummy who doesn't understand what substanceis a substantive de pro is. I think the idea is that if a state passes a law that restricts, let's say, your right as a gay couple to get married, that that right is so fundamental, you have essentially been denied due process. Even though this has nothing to do with process, it's like a substantive thing. You now, what i'm saying like this, either this right exists or it doesn't. But the substantive du process cases essentially say, well, there are some rights that we're just pulling out of a hat, that there's no process that could possibly satisfy these due process protections.
