Brown v. Board effectively overturns Plessy V. Ferguson and leads us into the new legal infrastructure of race relations in the United States. However, let us not over-celebrate that moment that quickly upon the heels of the civil rights movement, we get mass incarceration. We have other ways of managing black life in particular in this country. The system of racial banishment that operates under the name called deportation is a highly racialized regime. That was built during the Chinese exclusion period. It softened its edges, but it is still there.
