The question of whether the importuning by the president falls within the legislative sphere is certainly an open question. The right question I think is whether conversations with the vice president from outside the Congress or outside the Senate perhaps about his legislative duties are those protected by the speech or debate clause and if so, under what circumstances. There's certainly case law that you could use to argue that it's not protected.
