In almost every state, including Ohio, the Attorney General is separately elected so we don't have a unitary executive or the President. The governor in the state appoints the Attorney General there are a few states like that but not many. So you can end up in a situation where an agency under the governor's oversight takes a position that's contrary to that of the Attorney General. And I suppose one way the AG could resolve that is to simply not let the agency appeal since he is ultimately the lawyer for the state. But my boss has taken the view that people elected Attorney General to ensure that laws at least get their day in court.
